001 / The Legal Standard

Whatever appointment you sign, you have to be able to defend it.

Say an appointment relies on a fake qualification, an unchecked criminal record, or a hidden conflict of interest. That's not just an HR issue. It's an irregular appointment. It can trigger an Auditor-General finding. And it can mean you personally are held accountable. The rules are already clear on this:

Municipal Systems Act · ss.54A & 56

No required qualifications? Then the appointment doesn't count.

The law (Municipal Systems Act, sections 54A and 56) says a municipal manager or section 56 manager must have the required skills, competencies and qualifications. If they don't, it's not just risky — the appointment and the contract are treated as if they never happened.

Senior Managers Regulations

Test the person's competence before you appoint them, not after.

The Senior Managers Regulations require a competency assessment before you appoint someone to a senior role. If a candidate scores "basic," they're officially unsuitable. Courts have already cancelled appointments made when this rule was skipped.

Municipal Systems Act · s.57A

The law limits re-hiring staff who were fired — but you can't enforce that without a background check.

Section 57A of the Municipal Systems Act restricts re-hiring someone who was dismissed for misconduct. Without a public-sector employment check, you won't even know about the earlier dismissal. Re-hiring that person becomes an irregular appointment too.

Appointment conditions · 60 days

Financial interests must be declared — and then checked.

Standard appointment conditions require you to verify qualifications, run security vetting, check for a criminal record, and get financial interests declared within 60 days. Simply collecting the declaration isn't enough — checking it is what lets you defend it later.

Every legal duty, matched to the proof that covers it.

Most municipalities are already meeting these duties. What they usually can't do is prove it when asked. Each legal or appointment requirement below is matched to the VEXLOTEX service that gives you the proof.

003 / Senior Appointments · s54A / s56

Five checks. One file. An appointment that holds up under scrutiny.

Senior appointments carry the biggest legal risk in a municipality — and the clearest rules on what checks are needed. VEXLOTEX puts together the full senior-appointment evidence pack in a single process:

Check the qualification at the source

We confirm qualifications directly with Umalusi, the national qualifications register, and the issuing institutions — so you know the required qualification is real.

HPCSA-accredited competency assessment

This assessment is matched to the official senior-manager competency framework. It meets the legal requirement for an assessment and screens out "basic"-range candidates before they're appointed.

Fingerprint-based criminal check and identity check

We run fingerprint checks against the SAPS Criminal Record Centre through accredited AFIS infrastructure. This meets the vetting requirement with a result the government recognises.

PERSAL and employment history check

We check public-sector employment history and confirm it directly with past employers. This surfaces any past dismissal before it becomes a section 57A problem for you.

Conflict-of-interest and directorship check

We search directorships and business interests to confirm the financial-interest declaration is accurate — instead of just taking it on trust.

What lands in your inbox: an appointment certificate, plus every underlying check — redacted, timestamped, ready to produce.

This file can't be picked apart by an Auditor-General finding, because every step already happened, on record, before the appointment was signed.

How the protection is structured

The Auditor-General looks at today — not just the day you made the appointment.

A clean record at hiring doesn't stay clean on its own. Three years later, things can change. VEXLOTEX protects the whole time someone works for you, and keeps a dated record at every step.

Phase 01

Pre-Appointment Checks

We verify identity, qualifications, criminal record, competency and financial interests before the appointment letter is signed — so the appointment is valid from day one.

Phase 02

Ongoing Checks

We re-check criminal records every six months, credit every quarter, registrations every year, and conflicts of interest continuously. This catches change before it turns into a finding.

Phase 03

Fast Response When Needed

If something comes up — a suspected conflict, a fraud investigation, or a lifestyle that doesn't match a salary — we move fast with lifestyle audits and certified polygraph tests.

004 / The Defensibility Engine

A check only protects you if you can produce it when asked.

Every VEXLOTEX engagement includes the Insights Platform at no extra cost. That means central tracking, POPIA-compliant consent storage, automatic re-screening alerts, and a complete, timestamped evidence file for every appointment — ready in seconds when the AG, the MEC, or a court asks for it.

Set up to be procured the way municipalities actually buy.

We fit into your SCM process — ready for a quotation or tender on request. Pricing is worked out per municipality, based on role mix, volume and how deep the screening needs to go, with clear per-service and package rates in the proposal.

Tax compliance

006 / Questions

Straight answers, no jargon.

It evidences the competency assessment and background checks the regulations require before a senior appointment — mapped directly to ss.54A, 56 and 57A, so you can show exactly which requirement each check satisfies.

Courts have cancelled appointments made without the required competency assessment. If you're not sure a past appointment is defensible, that's exactly the gap the senior-appointment evidence pack is built to close — talk to us before an audit finds it first.

Both. The same evidence approach covers senior-appointment compliance and supplier/bidder due diligence under MFMA SCM and the PPPFA.

Every check lands in the VEXLOTEX Insights Platform as a timestamped, audit-ready record — built so you can answer an AG query with evidence, not a scramble.

That a supplier is properly registered on National Treasury's CSD before you engage them — one of the standard procurement-readiness items we help you evidence alongside B-BBEE and tax compliance.

Yes. The first conversation is a free consultation to map your obligations to the right checks — no procurement process required just to start that conversation.
